Lex mercatoria is one of the oldest branches of law which has many particularities. Thus, customs continue to be used in commercial law up to now and the branch itself notwithstanding its “flexibility” remains conservative in certain sense. As one of the most dynamic branches which are used in many jurisdictions it affects complicated legal problems first of all as for the interpretation and application of foreign countries law.
